Re: Ethics Complaint against Sarah Palin Dated June 2, 2011

Dear Mr. Burns:

I am in receipt of your letter dated July 29, 2011 which denied the Ethics Complaint  previously filed. I am also in possession of the documents sent by your office with a cover letter of August 17, 2011 in response to my Freedom of Information Act request. As a result of those documents it is my understanding that Sarah Palin has waived confidentiality of any information regarding this matter.

As a starting point I hereby request that you disqualify yourself in this matter due to personal bias, or potential bias in this matter. It is clear from the documents produced that you have a personal relationship with Sarah Palin and/or her attorney. Secondly you were appointed by Sean Parnell, who became governor upon the resignation of Sarah Palin. It also appears you have been a fisherman in Bristol Bay for many years, so the implication is that you may have a personal relationship with Todd Palin.

You have a second potential conflict of interest. AS 39.52.190 expressly establishes that any public officer is prohibited from aiding another in the violation of the Ethics Laws of Alaska.  If it is determined that Sarah Palin in fact violated the Ethics Code of Alaska, and that you aided her by dismissing a complaint rightfully filed against her, you may have personally violated the Alaska Code of Ethics.

This matter would be more fairly considered by an independent, bipartisan, investigative board, and then there would be no indication of bias or undue influence on your part.

I hereby request production of all documents covered by my Freedom of Information Act request, without the withholding or redacting of any such documents. In particular you have withheld and/or redacted the following documents:

1. E-mail from Julia Bockmon dated June 7, 2011 to you, James Cantor and Joanne Grace re my Ethics complaint against Sarah Palin dated Jun 7, 2011 which was listed as having “High” importance.” The copy provided to me is redacted with the following explanation: “Summary and Analysis regarding June 2, 2011 Ethics Complaint against S. Palin Attorney-Client Communication and Deliberative Process and Attorney Work Product.” Who is the attorney and who is the client, upon which you base this asserted privilege? Surely you are not asserting a privilege on behalf of Sarah Palin as anything sent to your office would constitute a waiver of that privilege. Moreover you are a public servant of the people of Alaska, and as such any “deliberative process” undertaken by your office regarding an Ethics Complaint should not be “protected” from production. It is also my understanding from documents that were produced that Sarah Palin, through her attorney, has waived any privilege they might have otherwise been asserted. Certainly the production of the “Confidential” Ethics Complaint (the one made the subject of this letter) by Sarah Palin’s attorney to conservatives4palin, which was published on the internet, would also constitute a waiver of any privilege.

2. Documents identified in the “Protected Records Log” that were both withheld in their entirety dated July 15, 2011 with a Bates stamp range from 00057-00059, and 00071-00074, which were described as “Summary analysis, and recommendation regarding the Jun 2, 2011 complaint and the July 7, 2011 supplement, and Exhibit B to the July 15, 2011 Memorandum: Draft Letter to M. Litman regarding Ethics Complaint against Sarah Palin dated June 2, 2011. Any assertion of privilege is inappropriate and unfounded.

I am hereby asking for your reconsideration of the Ethics Complaint previously filed for the following reasons: (1) the dismissal of the Ethics Complaint was contrary to the clear and express provisions of the statute, and (2) additional information has come to my attention, which if an investigation  had been performed, would have resulted in this ethics complaint being even more compelling.

1. The Dismissal of the Ethics Complaint was Contrary to the Express Provisions of AS 39.52.180 (a).

As you stated in you letter of July 29, 2011 the statute involved originally expressly excluded … “legislative bills.” In 2007, during Palin’s term as Governor, you explained that the statute was amended “to include, rather than exclude, work on legislation.” (Your letter at page 2) Thus after the amendment AS 39.52.180(a) stated:

“ (a) A public officer who leaves state service may not, for two years after leaving state service, represent, advise, or assist a person for compensation regarding a matter that was under consideration by the administrative unit served by that public officer, and in which the officer participated personally and substantially through the exercise of official action. For the purposes of this subsection, “matter” includes a case, proceeding, application, contract, [OR] determination, [BUT DOES NOT INCLUDE THE] proposal or consideration of a legislative bill [BILLS], a resolution, -[RESOLUTIONS AND] constitutional amendment [AMENDMENTS], or other legislative measure, [MEASURES;] or …”

There is no dispute that this statute (1) applies to Sarah Palin as the Ex-Governor, (2) That the Ex-Governor signed the tax credit statute into law during her short term as Governor (AS 39.52.180 (a) ) (3) that during a period of less than two years after Sarah Palin resigned as Governor she received compensation as the Executive producer and for staring in Sarah Palin’s Alaska (4) the compensation paid to the Ex-Governor for making the film was $2,000,000, and that (5) the film company involved, Jean Worldwide, received a tax credit of $1.200,000.00 at the expense of the citizens of Alaska.

According to your letter, your only justification for dismissal of the complaint is that the term “matter” does not include “legislation” after it is enacted. In particular, you state, “Once a bill is enacted, consideration of the legislation, the “matter” is concluded. Future work that involves application of the statute to later activities is not “regarding (the)matter.” It appears you are rewriting the law. Your attempt to interpret the statute to impose some arbitrary time period during which the “legislation” signed by the Governor would be considered to be a “matter” is without justification, without legislative history, and contrary to the express language of the statute. Your analysis is ludicrous! To suggest that “legislation” is not “legislation” after it is signed by the Governor, and becomes law, is nonsensical. If a proposed law never became law there would never be a situation where the Governor or a member of the Executive Branch would benefit or receive compensation from the “law,” as there would be no law. To take your position to its logical extreme, if Sarah Palin signed a law during her term as Governor to award a tax credit of $1,000,000 to anyone who gave birth to a 6th child in Alaska, and then within the two years after she resigned she had a sixth child in Alaska and received the tax credit, that would not be a violation of the Ethics Act, because the legislation was “concluded” and the birth of the child was a “later activity.” Any Governor who received compensation after leaving office regarding “legislation” they approved while in office would ALWAYS be a matter that was “concluded” at an earlier time. According to your interpretation, if a Governor resigned she would never be in a position to be involved in any way with legislation since the “matter” was concluded. This construction of the law would make the law nonsensical. Your stated interpretation of the law is inconsistent with the express wording of the statute, and if your interpretation of the statute were adopted there would NEVER be a violation of the Ethics act that pertains to “legislation” because you interpret “legislation” to be something other than “legislation.”

By taking the position that this law does not apply to Sarah Palin then you are necessarily telling the citizens of Alaska that the law applies to everyone equally unless you say otherwise. The citizens of Alaska could have received compensation of 5.2 Million Dollars (double the 2 Million Dollars that Palin received, and refund of the 1.2 Million Dollar Tax Credit from Jean Worldwide) for this violation. The citizens of your state deserve a hearing on this matter by an unbiased committee.

2. New Evidence

Since the filing of the Ethics complaint additional information has come to light that should be considered in evaluating this claim.

1) Documents enclosed indicate that during the short time that Sarah Palin served as Governor, she traveled on state time, using state funds, to meet with film companies in California (see attached). Obviously she was contemplating the making of a film for personal gain, before she left office. Obviously if she had been involved as Governor in the making of this film, she would not have been allowed to receive compensation. By enacting this law and resigning from office, Sarah Palin was able to profit from Senate Bill 230 as an actor and Executive Producer of Sarah Palin’s Alaska. This is precisely the type of conduct that AS 39.52.180 (a) was intended to prevent.

2) The Department of Commerce, Community, and Economic Development (DCCED) regulations governing the Film Office and the film incentive program were drafted, issued for public comment and became effective on June 18, 2009.  Sarah Palin announced her resignation as Governor, just two weeks later, on July 3, 2009. Until now many people failed to understand the timing of Palin’s resignation. It appears that we now know the reason for her sudden resignation.

3) It now appears that Sarah Palin and her daughter Bristol, are each planning to appear in additional films that have applied for tax credits, taking further advantage of Bill 230. Helping Hands is the Company that has applied for the tax credit for the film featuring Bristol Palin. Jean Worldwide has also applied for an additional tax credit but the documents that have been provided to me as a result of my Freedom of Information Request to the film office have been redacted so I am unable to confirm if Sarah Palin will be featured in this film or if she might be the Executive Producer of this film. I suspect that is the case given the fact that it is the same company, Jean Worldwide, and based on the report that Palin will be featured in a television show to be known as “Big Hair.” 

Bristol Palin will be featured in a film, for which a tax credit has also been requested. That company applying for that tax credit is Helping Hand,  and it appears they have applied for such a tax credit. 

I incorporate all the facts and assertions in my Ethics Complaint of June 2, 2011 that has been identified by your office as AGO File No. AN2011101972.

In light of the fact that Sarah Palin is considering running for President of the United States, it is essential to the safety and security of our entire country that people know the truth about any Ethics Violations of Sarah Palin during or after her short time as Governor of Alaska. On behalf of the entire electorate in the United States I seek the truth, and ask that this Complaint be considered by an independent bipartisan legislative panel.

    Sarah Palin was interested in doing a Reality show early as Gov. Bailey documented in his book, that Palin was thinking of doing it, and Bristol said “The will see some shit” and Sarah giggled…shocking Bailey.
    So she has been THINKING of is for quit some time, just didn’t put the “Tax credit” in place until right before she left.

      I would encourage everyone reading to send letters and make calls demanding that a bipartisan committee be convened to consider this complaint, instead of simply relying on the ‘AG’s statements that “legislation” doesn’t mean “legislation”.

      1. Yes, you are correct. This is not the country I chose when I was a young adult. Now, it is a country that is turning into a fascist state, run by the corporations and for the corporations. Very, very soon, we will be back in the early 1900s or earlier with the rubber-barons. Perry et al want to prevent our children from getting an education, and they want to stop our social safety nets like Soc Sec and Medicare – Bachman wants to abolish the education department, Perry wants the churches to take over ‘like in the old days’ to care for our old, poor and infirm. The Koch Brothers are kindling all kinds of fires amongst the very people who actually are being helped by the safety net, but somehow they seem to be too dumb to realize it (as is shown by that study that was done when something like 60% of old folks did not know that Soc. Sec was a government program.)
        I don’t know what our country is coming to, but I am checking my options of relocating to somewhere else where people still care, and where government is not totally beholden to the Big Mammon.

  5. Thank you, thank you, thank you Malia! And now Van Flein is legal representative to another former Alaskan, a dentist living in AZ. Those two (Sarah and Bristol) could make 1-2 movies a year. Nice little scheme they worked out. She has no intentions of seriously running for president, but sure getting a lot pf publicity for her future movies she set up for making money. Both, total failures but lots of money for her. I hope the guy making the movie about her got the tax credits for exposing her! Wasn’t that filmed in Alaska? Is she going to buy a home in Korea (N or S) to beat the wrap? 🙂

The show about Big Hair Salon is really happening, and it is the salon where Palin get’s her hair done

      1. Doing a quick search, found a number of links with the same blurb about the Palin/Massey reality show when it was first announced in May.

        Note how they have included ‘her move from Alaska’ which I suspect is their way to cover the tax benefit. What will they do – show her on the phone accepting the contract or talking to Kyle and then show her packing her truck?? Whoopdee (sp???) do. If that is it, it sure does not warrant a tax benefit.

        The funny thing is that she bought the home in Arizona, and live there and then moved to California. I can’t wait to hear about how she is living in the house in Alaska.

        I went snooping around the property tax info for Matsu and nothing came up for BP or BSMP LLC. Maybe she’s ‘renting’ part of the compound house!! The garage is over 4,000 sq ft!!! I recall Palin’s purchase of the Phoenix property was hidden under some other name so Bristol may have done it that way too — to keep it in the shadows.

        What I did discover is the second house/garage that was built by Palin was finally assessed for taxes for 2011. Buildings were assessed at $515,600, Land 118,900 (2.16 acres) – Taxes 7,595 for 2011

        Also interesting, as I have a list of the various properties when that 2nd house was built and the cabin property were topics of discussion. There is another property now listed under Todd Palin, Tod Richards (??) and Ron & Carolyn Hanson (Brita’s parents). 5 acres land with cabin. Two maps – one named Flathorn Lake , The other showed it on Alexander Creek. Thought possibly bought for Track/Brita but having this Tod Richards in there somewhat confuses the picture.

        I sent a email to you. Maybe you can post all their emails so everyone can send to them. I focused on the the “Abuse” of power issue and this film credit issue was one of the things I used.
        You will see. I emphasized to the Legislature that as Alaska’s Lawmakers…. Palin is blatantly abusing the law for her own gain, and if she decides to run all eyes will be on them….and if she doesn’t run the movie (Nick Broomfield) and books that people are going to be looking at them. Also Bailey’s book show she lied through her teeth. Troopergate Should be reopened with this new evidence.

  14. Tax credits in the entertainment industry help the state more than they hurt. ie Detroit. Christie effed himself over when he dropped all the TCs on Jersey, making the law and orders etc move to expensive NY. Look at the films being filmed in AK. They used to film in BC or other parts of canada and SAY it was AK.

    Only good can come from AKs tax credit bill.You’re being mean just to be mean.

      You misunderstand. I am not saying that Alaska shouldn’t have this law. I’m not saying that Palin couldn’t make this television show. It was a violation of the Ethics code for her to star in such a film and serve as the Executive Producer of a film that made her a lot of money within two years of resigning, and which was a political advertisement. Surely you would agree that no state should be required to pay for a political advertisement of any candidate.

And the tiniest criticism of her — I think many of your viewers may not know this. No conservative on TV will criticize Palin, because they don’t want to deal with the hate mail.”

    WOW … ! When Fake News allows an attack like that from Ann Coulter … ?

      You are so right! The Ethics laws in Alaska apply to Government officials, and you don’t have to be a citizen of Alaska to file a complaint. Especially when a person is suggesting that they might run for President of the United States, we should all be looking into past unethical behavior.

  19. Malia, thanks for your efforts. You did an incredible job! I’ve been wondering how you would follow this up. What amazes me is how the senators and Parnell just ignore all of this. Maybe they think it doesn’t matter anymore, but it does! The senators may say it’s state rather than federal business, but Parnell should care. And these people are Christians but think stealing from the tax payers is ok?? I wonder if you would get anywhere with the state legislature. Just a thought. Sarah and these film companies obviously feel that they are doing nothing wrong. That this is their right! How scary is that! And Sarah you are such a lying hypocrite.       What is astonishing to me is that the politicians in Alaska continue to protect her even though she’ll be out of Alaska to live in her Arizona home as soon as she can’t get any more money out of Alaska. When are they going to catch on?

    I couldn’t find your email address, so will post this here; sorry that it is off topic.

    Do you think MSM would take notice if we set up one of those online petitions?

    A statement that clearly and simply declares something like this [or a variation]:

    Sarah Palin did NOT give birth to Trig on April 18, 2008, but has used him and his disability for political purposes. We dare Sarah Palin to sue us. She can’t, because she perpetuated a pregnancy hoax.

    Perhaps you could keep the petition under wraps until we have a certain number of names, say 1000 or so, to generate a more striking reveal.

    I am sure that the statement could be worded better, but do you think this idea has any merit?

      I think the idea has merit, but might not achieve the desired result. If someone might determine who her insurance carrier was and draw their attention to a potential insurance fraud, they might pursue this. They could file a suit and demand a paternity test to prove that Sarah didn’t give birth to Trig, so they would have been the victims of fraud.

    2. I’d rather we go after her for her graft in office or her political behavior thereafter, rather than the ambiguous birthing of Trig. We need to keep our opposition to her focused on her politically — and keep it high-minded. She is dangerous because of her political ambitions, far less so for potentially being a liar in her personal life.

  23. Curious why you sent it to Duke? I’m “in the neighborhood” here in NC and that just struck me as unusual– do you have a special Duke connection? Did you go to school there? Where ever you went to school, that might be a place to send your letter to– student newspaper or what have you– the fact that you, as an alum, wrote it surely would be of local interest….. which could then snowball. Just a thought.

      No, I have no connection to Duke. My initial thought was that I would send it to all the Law Journals in Alaska to get an independent assessment of this statute. I found that Alaska has NO law school, and that Duke has an “Alaska Law Journal”. Of course there is no guarantee that they will accept this as a topic and write about it, but my hope was to find an objective source. I would love to have it evaluated by Harvard, Princeton, Yale, and/or Stanford’s Law Schools, but I might be accused of bias, and Palin might say that they were “elite” schools, so this seemed to be the best I could find.

I know very little about law but it really sounds to me from reading the information you have posted on this subject that Sarah Palin violated legislation that she herself signed into law during the short time that she was Governor. They didn’t provide a valid reason for dismissing the charge and it sounds like they don’t even feel that it’s necessary. It’s almost as if they decided in advance that all ethics complaints and charges against Sarah Palin were frivolous because she wouldn’t have resigned from office in 2009 for that reason unless it was absolutely true! They would rather give Sarah Palin a free pass and ignore the fact that she benefited financially from her own legislation that she signed into law because the State of Alaska also greatly benefits from this reality show as well. Even though it’s obvious imho that Sarah Palin is definitely guilty I don’t think they will ever acknowledge it Malia. If Palin looks bad then they look bad and they really don’t want that, it’s easier to dismiss her charges since most people don’t have the time and energy, knowledge or financial means to continue with legal pursuit. I wish you the best with this. I thought your complaint against Palin was completely valid, the judge was guilty of frivolously dismissing your complaint with a really lame excuse!

      Thanks for your comment, and I think that you are totally right. I think she violated the ethics law, the Attorney General just wasn’t going to find her to have violated the statute regardless of how blatant it was, and it is unlikely that they will pass this on to a legislative committee! However I think it is wrong and if the AG commits a violation of the ethics act, surely that would have to be considered by an independent committee, and in considering a claim against him, they would have to determine if the original claim against Palin was valid. Thus if he refers this to a bipartisan committee, it may only be because he has potential personal exposure. I guess we will see! Thanks, Malia

  25. Hello Malia! I wholeheartedly admire your tenacity and dogged determination in the relentless pursuit of the truth to expose this two-bit chiseler and hustler. I personally think that this long sordid nightmare that is $P is about to come to an ignoble end. For three long years we have endured nothing but empty platitudes and lies spewing from that filthy trap of hers; the party’s over. The perfect storm is brewing; the books, Mr. Broomfield’s documentary, hell, even her so-called “friends” at Faux are calling her out for pussyfooting around. $P has more than overstayed her welcome on the national stage; she will crash and burn big time. Once again, way to go Malia for keeping the fire under her ass red-hot!

  27. Got to love the graft and corruption on Alaska, which makes the lower 48 look positively lily white (not with their snow). In a state of 700,000 people, cronyism is the norm. (I remember in 2008 that the Alaska Daily News Web site had a whole page of politicians under investigation by the FBI.)

    However it is reprehensible that AK elected officials kow-tow to the Palins as though those hillbillies were untouchable. The Alaskan voters are no longer enthused about her, but S.P. ” must have photos”, as the expression goes, on people like Burns.

    Keep up the pressure, please, Malia. Maybe it’s time to go higher up the legal food chain.
